Julian Elija Crushshon-Fleming, 25, Elysburg, PA, was sentenced to 9 months to 23 months incarceration followed by 36 months of probation after being convicted of the offenses of Driving Under the Influence of Alcohol and Involuntary Manslaughter arising from a fatal ATV crash. Crushshon-Fleming was the driver of an ATV with Alyssa Boyd as a passenger when the ATV struck a deer. Authorities did observe a deceased deer at the scene. Both Chrushshon-Fleming and Boyd were thrown from the ATV resulting in the death of Alyssa Boyd. Neither rider was wearing a helmet at the time of the accident.
“This was an extremely unfortunate case,” noted District Attorney Richard Wilson. “While we were confident that we could prove Crushshon-Fleming committed a DUI offense, proving the connection between that and the death of the victim would be difficult,” Wilson noted. Crushshon-Fleming was originally charged with more serious felonies. However, there was no guarantee that a jury would unanimously agree that he was guilty of those after a trial. “While Crushshon-Fleming’s intoxication did not help matters, a jury would likely conclude that the collision with the deer caused the riders to crash, and therefore the victim’s death, not the alcohol intoxication,” Wilson noted. “Manslaughter is therefore an appropriate resolution,” he added.
